HOT OFF THE PRESS!
There are a variety of companies that interfere with the legitimate operation of small home-based businesses. These companies use legal jargon and various maneuvers to illegally shut down mom and pop businesses that have not violated any laws.
It is also acknowledged that there are businesses that are legitimately engaged in the lawful protection of their rights.
However, many companies have adopted the strategy of attacking online auctions to show their muscle. Internet sellers are easy targets. Most are small businesses that can't afford to fight back even when they have done nothing wrong.

Whether you are a seller on an auction site or you sell products on your own website, you should know the importance of Trademark and Copyright violations.
You may have already had your listing(s) pulled from an online auction site or received an email from a well known company demanding to take down an offending sales page due to copyright infringement.
You should be aware that not all actions taken by such persons are illegal. There are cases of infringement that are terminated and should have been terminated. It is the opinion that these companies use questionable tactics to interfere with what is felt and believed as legitimate auctions.

What Is Your Reaction?
Are You Outraged?
Do You Give In?
Do You Fight Back?
Here Is An Example Scenario:
You buy some fabric, with a trademark design, to make bedding accessories, hair scrunchies, curtains or whatever it is you create and you offer your item for sale. You create an auction listing and soon, there are bidders on your item.
Before You Can Blink An Eyelid,
Your Listing Has Been Taken Down!
You receive an email from your registered auction site administrators (or directly from the company to your website requesting you take off the offending sale page) with information as to
why your listing was taken down with an enclosed email contact to the company concerned. (
Ebay are forced to do this at the demands of the company in question). They also notify all your bidders as to why your listing was pulled.
You have just
lost a sale and your bidders now think your
selling methods are questionable.
YOUR REPUTATION IS AT STAKE!
You Contact The Company Using The Email Provided And Ask Why.
The company replies with a lot of
intimidating and
threatening legal jargon that you don't understand. Now you believe you have committed a
serious offense and are afraid to pursue it further, so you leave well alone and find something else to sell.
If you try to relist the item again, the auction site will take it down with a warning of further action ie
suspend your account.
